Moreno Gallo really doesn't want to leave Canada for the old country.
He was convicted for the 1973 murder of Angelo Facchino and captured on police surveillance photographs in 2005 with the since-slain Montreal Mafia patriarach Nicolo Rizzuto Sr., and last year he lost a court challenge against a deportation order by the Canada Border Services Agency.
However, the Italian native has launched a new challenge to the deportation order through a court appeal as reported by Paul Cherry for The Montreal Gazette:
Gallo's latest appeal claims that because he was convicted 1974, the question over whether he can remain in Canada depends on an interpretation of the Immigration Act that was law at the time. Back then, Canada would not have been permitted to deport a permanent resident with a serious criminal record who had resided in Canada for many years.
Hope springs eternal.
