A federal judge has denied a bid by Gambino killer Charles Carneglia for a new trial.
Carneglia was convicted in March 2009 on a racketeering charge involving four murders, and sentenced in September 2009 to life in prison.
In moving for a new trial Carneglia argued that his defense lawyer should have put him on the witness stand but Judge Jack Weinstein who presided over the 2009 proceedings wasn't buying it as reported by Mitchel Maddux for the New York Post: "'Taking the witness stand ... would have allowed the government to demonstrate convincingly' that Carneglia was 'incorrigible, with a background that would be terrifying to any juror,' Weinstein wrote. 'Taking the stand would have sealed his fate.'"
Carneglia was known for disposing of his victims in vats of acid.
Apparently years of smoking have left the 65-year-old mob thug wheezing as he serves out the remainder of his life at a maximum security prison in Pennsylvania as reported by John Marzulli for the Daily News. When Judge Weinstein asked the mobster "how do you feel?" during the conference call on his motion for a new trial, Carneglia replied: "Terrible. I can’t breathe. I smoked for 50 years."
Just wait till he starts inhaling the sulfur fumes in hell.
